Terms of use

These terms apply to your use of rivelune.yachts and our introduction service, operated by Anthony Cooper and Miriam Cooper trading as Rivelune ("Rivelune", "we"). By using the website or sending us an enquiry, you agree to them. If you do not agree, please do not use the website.

1. Our service

Rivelune is a yacht charter introduction service. We discuss your plans and may introduce you to a Monaco charter brokerage suited to them. Our service is free to you. The brokerage pays us a referral fee when a charter is booked; fees vary between brokerages and do not change the terms you agree with the brokerage. We do not promise that the price you pay is the same as, or lower than, booking with a brokerage directly.

2. What we do not do

  • We do not own, operate, manage or charter yachts.
  • We do not act as your agent or broker, and we do not negotiate or sign contracts on your behalf.
  • We do not receive or hold charter fees, APA, deposits or any other client money.
  • Before introducing you, we discuss your plans with the brokerage. We do not inspect yachts or crews or verify brokerages' licences or insurance, so please make your own checks before signing. We also do not verify the safety certification or financial standing of brokerages, owners or operators.
  • We are not in partnership or a joint venture with any brokerage, and no brokerage is authorised to make promises on our behalf.

3. Charter contracts

Any charter is arranged and contracted solely between you and the brokerage, the yacht owner or their agent, usually under a standard charter agreement such as the MYBA Charter Agreement. Rivelune is not a party to that contract and has no responsibility for its performance. The brokerage, owner and operator are responsible for the charter, its terms, payments, cancellations, the yacht, its crew and your safety on board. An introduction is not a recommendation or endorsement of any particular brokerage, yacht, crew or operator, and you should make your own checks before booking.

4. No guaranteed outcome

We may decline any enquiry, and we do not guarantee that we will make an introduction, that any yacht, date, berth or event position will be available, or that a charter will be offered at any particular price. We aim to reply to enquiries within 12 hours, but response times are not guaranteed.

5. Information on this website

Prices, dates, availability and other information on this website, in emails and in our guides are indicative, for general guidance only, and may be out of date or contain errors. They are not a quote or an offer. Nothing we provide is legal, tax, financial, VAT or other professional advice; you should take your own advice before relying on it. Event dates and arrangements are set by third parties and may change. Always confirm all details, including prices, taxes, fees and cancellation terms, with the brokerage before you sign.

6. Your responsibilities

You must give accurate information, use the website lawfully, and make your own decisions about any charter. You are responsible for checking that any charter, contract and payment arrangements are suitable for you.

7. Our liability

Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

Subject to that, we are not liable for any loss or damage arising from: any charter, or any act or omission of a brokerage, yacht owner, operator, crew or other third party; your reliance on information on the website or in our guides; or any interruption, error or unavailability of the website. We are not liable for any loss that was not reasonably foreseeable.

If you use our website or service in the course of a business: we are not liable for any loss of profit, revenue, business, opportunity, goodwill or data, or for any indirect or consequential loss; our total liability to you is limited to £100; and you agree to indemnify us against claims, losses and costs arising from your misuse of the website or breach of these terms.

If you are a consumer, nothing in these terms affects your statutory rights.

8. Intellectual property

The website's content and the Rivelune name and logo belong to us or our licensors. You may view and print pages for personal use, but not copy or reuse them commercially without our permission. The Monaco Charter Guide and other downloads are for your personal use and may not be republished or sold.

9. Acceptable use

You must not misuse the website, including by submitting false enquiries, attempting to gain unauthorised access, introducing harmful code, or copying its content at scale by automated means. We may suspend or withdraw the website, or any part of it, at any time.

10. Events outside our control

We are not responsible for any delay or failure caused by events beyond our reasonable control.

11. Complaints

If you are unhappy with our service, email acooper@rivelune.yachts. We aim to acknowledge complaints within 5 working days and to resolve them within 30 days. Complaints about a charter itself must be raised with the brokerage that arranged it.

12. Changes

We may update these terms at any time. The version on this page applies when you use the website.

13. General

These terms are the entire agreement between us about your use of the website and our service; for business users, they replace any earlier discussions or representations. If any part is found to be unenforceable, the rest remains in effect. If we do not enforce a term straight away, we can still enforce it later. No one other than you and us has any right to enforce these terms.

14. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, you may also have rights under the law of your home country.
